This Hornbook provides an authoritative and comprehensive analysis of all aspects of federal multidistrict litigation (MDL), from the decision to consolidate by the Judicial Panel on Multidistrict Litigation (JPML) to appointment of lead counsel, case management, jurisdictional issues, attorney's fees, settlement, trial, and resolution. Written by three professors who have studied MDLs for many years, have had direct experience in MDLs, and have served on the Civil Rules Advisory Committee and at the American Law Institute, the analysis aims to be objective and to consider positions of various participants in MDLs. The intent is for this book to be a reliable resource for judges and attorneys handling multidistrict litigation cases, as well as a resource for scholars and students in the field of complex litigation. Because the precedents in this area are not always found in published opinions, but often in unpublished orders issued by district court transferee judges overseeing MDLs, we describe, analyze, and collect orders that can serve as models for litigants and judges alike.
